Welcome to DroneFTP ("we," "us," "our"). These Terms and Conditions ("Terms") govern your use of our website and services, including drone data processing, file storage, and transfer services (collectively, "Services"). By accessing or using the DroneFTP website ("Site") and Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using our Site or Services.

1. Acceptance of Terms

By accessing or using the DroneFTP website and Services, you acknowledge that you have read, understood, and agree to comply with these Terms, as well as our Privacy Policy and any other policies or guidelines we may provide in connection with the Services.

2. Eligibility

You must be at least 18 years old to use this Site and our Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age and have the legal authority to enter into this agreement.

3. Services

DroneFTP offers drone data processing, file storage, and transfer services to individuals and businesses. These services allow users to upload, store, and manage drone-captured data such as images, videos, and other file formats. The Services may include processing, analysis, and management of such data as specified in your subscription plan or individual agreement with us.

4. User Account

To access certain Services, you may be required to create an account with DroneFTP. You agree to:

Provide accurate, current, and complete information during the account registration process.
Maintain the security and confidentiality of your login credentials.
Notify us immediately of any unauthorized use of your account or security breach.

You are responsible for all activities that occur under your account and agree to use the Services only for lawful purposes.

5. Use of Services

You agree to use DroneFTP’s Services only in accordance with applicable laws and regulations. You shall not:

Upload or transfer illegal, harmful, or malicious content.
Infringe the intellectual property rights of others.
Use the Services to send spam, viruses, or other harmful material.
Engage in any activity that disrupts or harms the operation of the Site or Services.

6. Data Ownership and Usage Rights

You retain ownership of any drone data you upload or transfer to the Site. However, by using the Services, you grant DroneFTP a worldwide, royalty-free, non-exclusive license to use, store, and process your data solely for the purpose of providing the Services.

DroneFTP does not claim ownership of your data, but we may use aggregated, anonymized data for operational purposes, analytics, and improving our Services.

7. Third-Party Services

The Services may integrate with third-party tools or platforms. You acknowledge that DroneFTP is not responsible for the actions, content, or policies of these third parties. You agree to comply with any additional terms that may apply when using third-party services.

8. Pricing and Payment

Fees for the use of certain features or services are outlined on the DroneFTP website or in an agreement between you and DroneFTP. Payments for these services are due in accordance with the billing cycle specified in your plan or agreement.

You agree to pay all fees associated with your use of the Services. In the event of a payment dispute, you must notify us promptly. Failure to pay may result in suspension or termination of your account.

9. Account Termination

You may terminate your account at any time by following the process outlined on our website. DroneFTP reserves the right to suspend or terminate your account if you violate these Terms or if we determine that continued use of the Services would harm our operations or other users.

Upon termination, you may lose access to your data, and you are solely responsible for backing up any information stored on our platform.

10. Limitation of Liability

DroneFTP will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

Your use or inability to use the Services.
Any errors, omissions, or delays in processing your data.
Loss of data, including drone-captured images, videos, or files.
Third-party claims related to your use of the Services.

In no event shall DroneFTP’s liability exceed the total fees paid by you to us in the six (6) months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless DroneFTP and its officers, directors, employees, and agents from any and all claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Services or violation of these Terms.

12. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data when using our Services. By using our Site, you agree to the collection and use of information as described in the Privacy Policy.

13. Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, images, software, and other materials, are owned by DroneFTP or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any content without prior written consent from DroneFTP.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Kentucky/United States]. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located within Kentucky/United States.

15. Amendments

DroneFTP reserves the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting to the Site. It is your responsibility to review these Terms periodically for any updates. By continuing to use the Services after such changes, you accept and agree to the modified Terms.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms constitute the entire agreement between you and DroneFTP regarding your use of the Site and Services and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter.

Disclaimer
DroneFTP provides automated data processing tools for drone-collected data. While we strive to deliver reliable and useful results, we cannot guarantee the accuracy, completeness, or reliability of the outputs. The results of our processing are dependent on the quality and characteristics of the input data, including but not limited to resolution, coverage, sensor type, and environmental conditions. Users assume all responsibility for how the processed data is used, interpreted, or applied. DroneFTP and its affiliates shall not be liable for any errors, inaccuracies, or decisions made based on the processed data, and all outputs are provided “as-is” without any warranty, express or implied.

Refund Policy

1. Scope

This policy applies to all purchases of services, subscriptions, and/or licenses ("Services") offered by DroneFTP through droneftp.com. Unless otherwise stated, this policy does not apply to third‑party add‑ons, hardware, or equipment.

2. Refund Eligibility

We want you to be satisfied. Refunds may be granted under the following conditions:

- If the Service is not functional as described (e.g., major downtime or failure to deliver the core features) and you submit a support ticket within [30] days of the initial billing.
- If you inadvertently purchased or were billed for the wrong plan and notify us within [7] days of the charge.
- If required by applicable law (for example, consumer protection laws in your jurisdiction).

Refunds will not generally be granted in these situations:

You simply changed your mind about subscribing after service access has begun.
You have used the Service substantially and then request a refund based on dissatisfaction with results or outcomes.
You fail to pay for the Service, or are in breach of our Terms of Service.
For upgrades/downgrades: any difference in plan pricing may prorate or carry forward as credit rather than a refund, unless otherwise approved.

3. Refund Amount and Timing

If a refund is approved, we will credit the amount to the payment method originally used, or issue an alternative credit, at our discretion.
The refund request must be approved by our team and any amounts will be issued within approximately [10‑14 business days] after approval.
Usage may be taken into account — e.g., if you fully used the Service for the period, we may provide only a partial refund or credit at our discretion.
Note: If you cancel partway through a billing period, we typically do not pro‑rate and refund the unused portion unless exceptional circumstances apply (see eligibility above).
